A real life urban legend came true. A constrictor that will grow to a size of over eight feet, was discovered in this crib, wrapped around the leg of tiny seven month old Isabella Abatemarco, visiting her grandparents in Brentwood from upstate Troy. John Abatemarco, the grandfather says, "No grandfather wants to come home to find a snake wrapped around her leg"

In the middle of the night it was Uncle Charlie who heard the shrieks upstairs of Mother Cari and her daughter Isabella, "I heard screaming+came running- mother holding child-snake dropped off leg into crib--i grabbed a back scratcher to capture it, not knowing if it was venomous...."

The Abatemarcos say they hand just purchased the mattress from Toys R Us in Bay Shore They took photos: of the mattress before they returned it--a baby Sealy and plastic packaging which they say was open before they bought it-- Never dreaming that a hungry and thirsty snake might possibly be slithered up inside. They've hired a lawyer and plan to sue. The family's lawyer, Brian Gunn says, "Either the heat from the baby drew the snake out of the mattress or just the snake migrated out on its own looking for a meal"

"The snake is not poisonous, not indigenous to long island, the plan now is to have it adopted by an exotic animal expert.
The snake is being cared for at the Islip Town Animal Shelter. The toy store and mattress company say they are not aware of the case, and won't comment on pending litigation.

What kind of person thinks that this is ok. The snake could have wrapped itself around the baby’s neck instead of her leg. & these people aren’t just looking for a reason to sue. They had one handed to them. & if the snake was in my baby’s crib they wouldn’t have to worry about adopting it to an exotic animal expert!!! Another reason why America needs to keep our trade inside our country!!

People look for any reason under the sun to sue, it’s easy money. Chances are they will prove this story to be on the list of ridiculous, it really needs to stop.This story is what it is, a story.

rmseek1234 , your comments make perfect sense. HOW would they prove that the snake actually came out of the mattress, and was not already in the home??? THEY CAN’T!!! Sometime I just get so disgusted, when I hear the word SUE come out of peoples mouths! Almost every time some poor sap gets inconvenienced over something, THEY WANNA SUE. Why O why do we make it so easy for people to make “frivolous lawsuits”??
This is part of what’s wrong with the world today!! People think that if something bad happens to them, then someone else owes them money!!!

Do they know for a fact the snake was in the mattress? We lived in a mobile home years ago, and I had a snake get through one of the vents and hide behind my nightstand.It actually bit my husband when he tried to catch it-thank goodness it was just a corn snake. I also know of someone who recently took a load of clothes from their dryer, and went back to fold them, and found a snake in the clothes-apparently came in through the dryer duct. The point being, perhaps this was someones escaped pet, that found a way into the home and decided to curl up in the mattress-perhaps it smelled milk. I know cats and rats will try to get into a babies crib for that reason. I would have freaked too, gotten rid of the mattress and perhaps considered moving-but a lawsuit? Not sure about that. There are too many other ways for a snake to get into a home, without blaming the mattress people-unless there is proof positive.

forst off “as is” dosent mean what could crawl out of the matrish and they have just as good a chance to win a sute as eneyone elce they may not git as much as if someone was hurt but at least the price of the mattress and some for the scare the mother and baby had. If I was on the jury I would give them that much. I think that was harible the factory and storige building should have ben pest free then the snake wouldent crawled in the building to hunt rats and then took up living in the mattress because the food was plentiful.

That mattress had a heck of a hole in it for that snake to come out of it.
The lawsuit would have been filed on my behalf because I would have killed myself running down the stairs to get away from the snake. Snakes make my skin crawl.

We purchased a stove about 3 years ago and we had taken it out of the crate put it in place and and later that night we discovered a snake about 2 feet long that had to have come out of the crate, the stove I’m sure was at a warehouse somewhere and thats when it had to have gotten in. Can’t say we got much sleep that night, but the word SUE never came to mind, unfortunate things do happen at no ones fault, and you never know these days what’s for real.

I’d say they have NO chance of a suit, due to the fact no harm was done. Now had it have been a rattlesnake and bitten and hospitalized, or killed, maybe so. Hey at least they got a cool snake out the deal. I would have considered that an added bonus. But not all like reptiles as much as I. LMAO grin

If they bought the mattress with the plastic open already and they bought it as is, I don’t think they have much of a suit.
