GADSDEN, Ala. (AP) – A judge is considering whether to grant a new trial for an Alabama woman serving life without parole in the running death of her 9-year-old granddaughter.
Etowah County Circuit Judge Billy Ogletree told deputies to bring Joyce Hardin Garrard to court for a hearing Friday afternoon.
The 50-year-old Garrard wants the judge to throw out her capital murder conviction in the death of 9-year-old Savannah Hardin in 2012.
Garrard claims her trial included numerous mistakes. Among other things, the defense says the judge wrongfully prevented Garrard’s lawyers from presenting jurors with their theory about what led to the girl’s death.
Jurors found Garrard guilty in March. Prosecutors say she made the girl run until she collapsed as punishment for a lie about candy.
